And, perhaps, most important, is sending your communications to Carrier IQ a violation of the federal government’s ban on wiretapping?

This seems like it might qualify as wiretapping to me. The carrier is storing the content of your text messages. That's not just being a carrier anymore.

If I'm not mistaken, text messages and email are in a "gray area" as far as wiretapping.

Although it looks like having the program already on there allows them to call it "interception" which doesn't require a warrant at all.

We have long needed a "privacy amendment." It would solve so many problems.

Sad really. They simply rename wire tapping 'interception' and there go your rights to privacy. Reminds me of the OWS protests. It's right there in black and white in our Constitution, the right to free assembly, but in reality, that constitutional right is being undone by mere local ordinances.

"I'm sorry sir, is that a Bunsen burner I see there heating those beans? EVERYBODY OUT OF THE PARK!!!"

Where is the accountability? It does not exist. These corps (and our govt) just push the envelope as far as they can, then go 10 steps further for good measure. And the penalties and fines, if they ever materialize at all, are just an insignificant cost of doing business.

Rebranding is how the government has operated in recent years. "Patriot act", "Enemy combatants", "Clear skies initiative", "Healthy forests initiative", and the list can go on and on. Each of these terms was developed to obscure the truth. Josef Goebbels would be so proud. Its funny given that (as was pointed out by that British MP) Germany has finally taken over Europe. Their legacy lives on here, too.

I wonder if it only counts as wiretapping if the data are shared with law enforcement. I'm sure someone will sue, and the Supreme Court will eventually decide that barring companies from collecting and maintaining data impinges on their free speech rights. Not a joke.
