Even if they read you private documents with a warrant, I'm pretty sure that they couldn't use any information gathered against the victim because the information was gathered in such a way that it does not uphold 4th Amendment. Even if they later got a search warrant after finding incriminating information, they still would be unable to use the documents in court. The DOJ might believe this to be legal but there if it was appealed to the Supreme Court it would be hard to side against both the letter and spirit of the law.

So prior to email they surely would have found it acceptable to intercept and open any mail that they felt like reading, no?
