At this point, we're going to have to get congress to pass a low explicitly stating that APIs are not copyright-able to fix this mess

The judicial system is a better place for this, I think. Congress has the technical aptitude of a chipmunk. Whereas there's a real chance at least 5 justices might grasp the insanity of copyrighting APIs enough to rule against it. Judicial precedent also makes it harder for Congress to pass laws which directly support the reverse.

Isn't "not copyright-able" and "can't be copyrighted" the same? Serious question, it's a legalese in a foreign language for me.

Yes, he's saying we'll have to get a "trying to copyright an API is bullshit" law passed because the courts can't smell copyright-related bullshit themselves.
