Could you please explain what that means? In other words, affirmative consent is still necessary and is still valid when the affirmative consent is given under the influence of drugs and alcohol? There are plenty of drugs and all of the alcohols that will make you say 'yes' out loud when you may not have done so sober.

Intoxicated consent breaks the "conscious" part of "affirmative, conscious and voluntary agreement".

This may sound crazy, but what if two people are drunk and have sex, the woman is the initiator and is "on top" during the sex but the next day decides she didn't want to have that sex and was too drunk to have made that decision? Was she raped? Keep in mind the man could claim the same thing in this case but likely would be laughed out of court.

So you can still press charges for rape against the guy you had sex with cause you were drunk at the time, even though you verbally consented? D:

If you verbally consent and have drunk sex and wake up and everything is hunky dory, there's no need to press charges.

If there's an issue later, there's most likely an element of coercion that occurred which would violate "voluntary".
