You don't think there's a legit difference between "should be able to" and "have the right to"? They aren't even similar. Civil rights can't be left to the majority to decide. Thank heaven that this whole ballot initiative constitutional amendment bullshit wasn't around in the 50s and 60s. What if Kennedy or LBJ would have used the "my hands are tied" approach on Jim Crow? States' rights are exactly the argument that the Deep South used at the time. Only the federal government can put this issue to bed, and right now Obama looks like a triangulating, hedging pussy from where I'm standing.
