It's shitty to be throttled, but at the same time all the carriers are fighting a tsunami of data demand. AT&T has massively expanded it's network the last few year, but can barely keep up with demand. They have to do something, and if one of those somethings is throttle the top 5% then that is what they will do. T-mobile has represented on my ass in a customer service fashion in a ways that I wish all they had done was throttle me.
Mobile computing is still in it's infancy, hopefully things get better over time. If you talk to an engineer for one of these companies they make it sound like keeping up with increasing demand is like fighting the ocean.
